RE: The tariff classification of Dihydroergotamine Mesylate (CAS-6120-39-2) in bulk powder form, from Italy

In your letter dated September 10, 2012, you requested a tariff classification ruling.
The subject product, Dihydroergotamine Mesylate, is an ergot alkaloid. It is indicated for the treatment of acute migraine headaches.
The applicable subheading for the Dihydroergotamine Mesylate in bulk form will be 2939.69.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Vegetable alkaloids, natural or reproduced by synthesis, and their salts, ethers, esters, and other derivatives: Alkaloids of rye ergot and their derivatives; salts thereof: Other." The rate of duty will be free.
